Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Onflux. By creating an account or using the service, you agree to these Terms. Please read them carefully.
1. Acceptance of terms
By accessing or using Onflux, you confirm that you can form a binding contract and that you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Description of service
Onflux is a subscription-based software-as-a-service application that helps travel agents build, brand, and share client travel itineraries. Features and functionality may evolve over time.
3. Subscription terms
Onflux is offered for $30 per month, billed monthly, following a 14-day free trial. A payment method is required to start the trial; you will not be charged until the trial ends, and you may cancel at any time before then to avoid being charged. Before checkout, the price, trial length, and billing frequency are clearly disclosed, and you must affirmatively agree before any charge is made.
California subscribers:in accordance with California’s automatic renewal law, we disclose all subscription terms clearly before you pay, obtain your affirmative consent, and provide a simple cancellation path directly within your billing settings. You can cancel online at any time without contacting support.
4. Cancellation and refunds
You may cancel your subscription before your next billing cycle from your billing settings. Cancellation stops future charges; access continues until the end of the current paid period. We do not provide refunds for partial months.
5. Acceptable use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable law.
- Upload malicious code or attempt to disrupt or compromise the service.
- Attempt to gain unauthorized access to other accounts or our systems.
- Infringe the intellectual property or privacy rights of others.
6. User content
You retain ownership of the itineraries and other content you create in Onflux (“User Content”). You grant us a limited license to host, store, and display your User Content solely to provide the service to you.
7. DMCA takedown procedure
We respect intellectual property rights. If you believe content on Onflux infringes your copyright, send a notice to dmca@onflux.co that includes all of the following:
- A description of the copyrighted work you claim has been infringed.
- The URL or location of the allegedly infringing content.
- Your contact information (name, address, email, and phone number).
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Our full process, including the counter-notice procedure, is described in our DMCA Policy.
8. User-generated content liability
Agents are solely responsible for the content they create and share through Onflux, including its accuracy and its compliance with applicable law. Onflux is not responsible or liable for User Content created by account holders.
9. Data processing and your role as data controller
When you use Onflux to store information about your clients — including names, contact details, travel documents, and preferences — Onflux acts as a data processor on your behalf. You are the data controller for that personal data under applicable privacy laws, including the GDPR and CCPA.
As the data controller, you are responsible for:
- Having a lawful basis to collect and store your clients’ personal data.
- Obtaining any necessary consent from your clients before entering their information into Onflux, and informing them that their data is processed by a third-party tool.
- Honouring any requests your clients make to access, correct, or delete their personal data.
- Complying with all applicable data protection regulations in your jurisdiction.
Onflux implements appropriate technical safeguards including encryption at rest for sensitive fields (such as passport numbers and dates of birth), row-level security so that each agent’s client data is strictly isolated, and encryption in transit for all data. Onflux does not sell or share client data entered by agents with third parties.
10. Email and CAN-SPAM compliance
All marketing emails we send include a working unsubscribe link, a valid physical mailing address, and honest, non-deceptive subject lines. You can opt out of marketing email at any time; we will still send essential service-related messages.
11. Limitation of liability
To the maximum extent permitted by law, Onflux and its suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the service. The service is provided “as is” without warranties of any kind.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles.
